The United States has banned imports from three Chinese genomics companies, accusing them of working with the government of Xinjiang to enable the forced labour of Uyghur and other ethnic minorities. The move, announced on Wednesday, October 28, 2026, puts BGI Genomics, MGI Tech and Shenzhen BGI Technology on the Uyghur Forced Labor Prevention Act (UFLPA) Entity List, a designation that in practice blocks their goods from entering the American market unless an importer can clear an exceptionally high legal bar.

The BGI import ban is the latest use of a law Congress passed to keep products made with forced labour out of US supply chains. It also lands at a sensitive moment in the wider US-China relationship, where trade, technology and human rights have become tightly linked, and where genomics — the science of reading and analysing DNA — has become a strategic industry as well as a medical one.

Key Points

• The US added three Chinese genomics companies to the UFLPA Entity List on October 28, 2026: BGI Genomics Co. Ltd, MGI Tech Co. Ltd and Shenzhen BGI Technology Co. Ltd, also known as the BGI Group.
• The Department of Homeland Security says the companies allegedly worked with the Xinjiang government to enable the forced labour of Uyghur and other ethnic minorities.
• Goods from listed entities are presumed to be made with forced labour and are prohibited from importation unless US Customs and Border Protection finds, by clear and convincing evidence, that they were not.
• Beijing has regularly dismissed accusations of forced labour and other abuses against Uyghur and other Muslim minorities in Xinjiang.
• The listing is separate from the Commerce Department export restrictions already placed on some BGI units over genetic-data and surveillance concerns.

What Happened

Reuters reported on Wednesday that the United States had banned imports from the three companies, citing the Department of Homeland Security. The companies were added to the UFLPA Entity List, which identifies entities that use or facilitate the use of forced labour of Uyghur and other minorities, or that source material from the Xinjiang region.

BGI Genomics is listed on the Shenzhen stock exchange under the code 300676.SZ, and MGI Tech is listed in Shanghai under 688114.SS. Shenzhen BGI Technology is described by the US government as also known as the BGI Group, the Shenzhen-headquartered genomics group that is one of the largest genetics analysis companies in the world.

The Reuters report, by Karen Freifeld and edited by Doina Chiacu, did not set out a fresh response from the three companies to this specific listing. It noted, however, that Beijing has regularly dismissed accusations of forced labour and other abuses against Uyghur and other Muslim minorities in Xinjiang. That standing denial frames the diplomatic side of the dispute: Washington treats the listing as an enforcement action against forced labour, while Beijing has consistently rejected the underlying allegations as unfounded.

For importers, the practical effect is immediate. Once an entity is on the UFLPA Entity List, its goods are subject to the law's rebuttable presumption. US Customs and Border Protection (CBP) can detain, exclude, seize or forfeit shipments, and an importer seeking release must produce clear and convincing evidence that the goods were not produced with forced labour. That is a demanding standard, deliberately higher than the ordinary burden in customs cases, and it means many importers will simply stop sourcing from a listed entity rather than try to prove a negative about a complex supply chain.

Background and Context

The Uyghur Forced Labor Prevention Act was enacted in December 2021 and signed into law by President Joe Biden. Enforcement began on June 21, 2022. The law created a rebuttable presumption that goods mined, produced or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region, or produced by an entity on the UFLPA Entity List, are made with forced labour and are therefore prohibited from importation under Section 307 of the Tariff Act of 1930.

A Department of Homeland Security-led body, the Forced Labor Enforcement Task Force, reviews and designates entities. US Customs and Border Protection leads implementation of the presumption at the border. In official notices, CBP has said it has reviewed thousands of shipments valued in the billions of dollars under the UFLPA since enforcement began, a sign of how broadly the law now reaches into American import screening.

The Entity List is not a single, simple category. Under the law, the task force identifies entities in Xinjiang that mine, produce or manufacture goods with forced labour; entities working with the Xinjiang government to recruit, transport, transfer, harbour or receive forced labour or members of persecuted groups out of the region; entities that exported products made by such entities into the United States; and facilities and entities that source material from Xinjiang, including for government labour schemes described as poverty alleviation or pairing-assistance programmes. The consolidated list is published by the Department of Homeland Security and updated in the Federal Register.

Enforcement has accelerated during 2026. An analysis by the law firm Covington described a recent expansion in which the task force added 43 entities to the list — the first update since President Donald Trump took office for his second term and, at the time, the single largest expansion since the law was enacted. Those listings spanned sectors including aluminium, apparel, cotton and tomatoes, as well as mining, pharmaceuticals, electronics, energy and transport infrastructure, and were based on determinations that the entities either sourced materials from Xinjiang or took part in government-sponsored labour transfers out of the region. The BGI and MGI listings extend that enforcement drive into genomics, a sector where the United States has both commercial and national-security concerns.

BGI Import Ban: Why Genomics Is Different

Genomics sits at the intersection of health care, research and data security. DNA sequencing machines and the services built around them are used in hospitals, universities, pharmaceutical research and public-health laboratories. They also generate vast amounts of genetic data, which is why American officials have long worried about who controls that data and how it might be used.

BGI Group gained a foothold in the global sequencing market after buying more than 100 HiSeq2000 genomic sequencers from US-based Illumina in 2010, and later acquiring the US-based sequencing firm Complete Genomics in 2013, according to a report by the US-China Economic and Security Review Commission cited in legal analyses of the company. That history helps explain why Washington's actions against BGI have drawn so much attention in the research world: the company is not a marginal supplier, but a major player whose instruments and services are woven into laboratories around the world.

The United States had already restricted some BGI units through a different mechanism. In July 2020, the Commerce Department added Xinjiang Silk Road BGI and Beijing Liuhe BGI to its Entity List, saying they had conducted genetic analyses used to further the repression of Muslim minority groups. On March 2, 2023, it added three more affiliates — BGI Research, BGI Tech Solutions (Hongkong) Co. Ltd and Forensic Genomics International — citing information that their collection and analysis of genetic data posed a significant risk of contributing to monitoring and surveillance by the government of China, which had been used in the repression of ethnic minorities, and a significant risk of diversion to China's military programmes.

Those Commerce listings are export restrictions: they require government permission before sensitive US technology can be supplied to the named entities. The new UFLPA listing works in the opposite direction, blocking imports into the United States. The two lists are often confused because both are called entity lists, but they do different jobs, and a company can appear on one, the other, or both.

BGI has previously rejected human-rights accusations. After the Commerce listings, the group said its services were only for civilian and scientific purposes, that it did not condone and would never be involved in human-rights abuses, and that the US decision may have been affected by misinformation which it was willing and able to clarify. It did not, in that response, address the specific allegations about Uyghur or other Muslim minorities in detail, and it has previously denied providing technology to surveil them.

Reactions and Quotes

The Department of Homeland Security's position, as reported by Reuters, is that the three companies were added to the UFLPA Entity List because they allegedly worked with the Xinjiang government to enable forced labour. The department's published framework for the list is blunt: goods produced by listed entities are presumed to be made from forced labour and prohibited from importation to the United States.

Beijing's standing position, also noted in the Reuters report, is that it regularly dismisses accusations of forced labour and other abuses against Uyghur and other Muslim minorities in Xinjiang. Chinese officials have in the past accused Washington of improperly attacking Chinese companies when BGI units were added to Commerce restrictions, and BGI itself has said its work is civilian and scientific.

Legal and compliance specialists have warned more broadly that UFLPA enforcement raises the stakes for any importer with a China-linked supply chain. Because the presumption can only be overcome by clear and convincing evidence, companies are expected to map their suppliers, trace raw materials and components, and document labour practices — or find alternative sources. For genomics, where instruments, reagents and services can come from a small number of global suppliers, that diligence exercise can be especially complex, and universities and medical centres that collaborate with listed entities may also need to review research and procurement arrangements.

Why It Matters

The BGI import ban matters for three reasons. First, it is a human-rights enforcement action with real commercial teeth: it does not merely condemn forced labour in general terms, but names specific companies and blocks their goods at the border. Second, it extends US supply-chain enforcement into a high-technology sector that Washington increasingly treats as critical infrastructure, alongside semiconductors, pharmaceuticals and energy. Third, it adds another friction point to the US-China relationship at a time when the two countries are also negotiating over trade, tariffs and technology access, and when American officials have warned repeatedly about genetic data falling into the wrong hands.

For American patients and researchers, the immediate question is disruption. Genomics laboratories depend on reliable supplies of instruments, consumables and sequencing services, and a sudden loss of a supplier can delay studies or raise costs. The longer-term question is whether other suppliers — in the United States, Europe and elsewhere — can absorb demand, and whether the listing accelerates a broader decoupling of the American and Chinese genomics industries that was already under way after the earlier Commerce restrictions.

For China, the listing is another example of American law being used to police labour practices far beyond US borders. Beijing has long argued that such measures are political tools dressed up as human-rights policy. For Washington, the answer is that forced labour anywhere in a supply chain that ends in the American market is a US customs problem, and that the UFLPA was written precisely to make that point enforceable.

What Happens Next

Customs enforcement will be the first test. Importers with shipments from the three companies should expect detention and detailed questions about origin, suppliers and labour practices, and will need to decide quickly whether to contest a detention with evidence or to reroute orders. Companies on the list can seek removal, and the task force considers additions, removals and technical corrections on the recommendation of member agencies, decided by majority vote — but removal requires persuading the task force that the listing criteria are no longer met, which is not a quick process.

Diplomatically, Beijing's response will be watched closely, as will any reaction from the companies themselves, which had not, in the initial Reuters report, offered a fresh public comment on this listing. Further UFLPA updates are also likely: the task force has expanded the list repeatedly, and enforcement agencies have signalled that forced-labour screening will remain a priority. If the pattern of 2026 holds, genomics may not be the last new sector to be drawn into the net.

Frequently Asked Questions

Which companies are affected? BGI Genomics Co. Ltd, MGI Tech Co. Ltd and Shenzhen BGI Technology Co. Ltd, also known as the BGI Group. All three were added to the UFLPA Entity List on October 28, 2026.

Does the listing ban all of their products? In effect, yes for imports into the United States: their goods are presumed to be made with forced labour and prohibited from entry unless an importer proves, by clear and convincing evidence, that a particular shipment was not produced with forced labour.

Is this the same as the earlier BGI blacklisting? No. The Commerce Department Entity List restricts exports of US technology to named entities. The UFLPA Entity List restricts imports of their goods into the United States. Some BGI units were already on the Commerce list; the new action is an import ban under a different law.

Can the companies get off the list? The Forced Labor Enforcement Task Force considers removals as well as additions, on the recommendation of member agencies and by majority vote. A company would need to show that it no longer meets the listing criteria, which is a demanding process.

What should US buyers do now? Review any direct or indirect sourcing from the three companies, check whether shipments are in transit, and seek customs and compliance advice before importing. Documentation of the full supply chain is now essential, because the burden of proof sits with the importer.
