A Harris County grand jury has indicted a U.S. Immigration and Customs Enforcement officer on a felony assault charge after investigators concluded he deliberately drove his vehicle into a man who was fleeing on foot during an enforcement operation in Houston earlier this month. The indictment, returned on Friday, October 30, 2026, marks a rare instance of a local prosecutor bringing criminal charges against a federal immigration officer over force used in the field, and it sets up a legal fight over whether a county district attorney can prosecute a federal agent for actions taken on duty.

ICE officer Mario Alberto Morales, 33, is charged with second-degree aggravated assault with a deadly weapon — the vehicle he was driving — in connection with the October 10, 2026, collision that left Miguel Parra-Hernandez, 48, with a broken leg and injuries to his hip and ankle. If convicted, Morales faces between two and 20 years in prison under Texas law. District Attorney Sean Teare announced the charge at a news conference on October 30, saying the video evidence in the case was as clear as anything he has prosecuted or investigated.

Key Points

• A Harris County grand jury indicted ICE officer Mario Alberto Morales, 33, on October 30, 2026, on one count of second-degree aggravated assault with a deadly weapon.
• The charge stems from an October 10 enforcement operation near Clay Road and Highway 6 in northwest Harris County, in which Morales's SUV struck Miguel Parra-Hernandez, 48, as he fled on foot.
• Parra-Hernandez suffered a broken leg and hip and ankle injuries, underwent surgery, and remained hospitalised weeks later, according to prosecutors and his family.
• District Attorney Sean Teare says surveillance and bystander video shows Morales deliberately steered into Parra-Hernandez; ICE calls the indictment a "political stunt" and denies the strike was intentional.
• The case also raises questions about evidence handling, after investigators said ICE officers left the scene with the SUV before it could be impounded for forensic examination.

What Happened

Shortly after 7:20 a.m. on October 10, 2026, Harris County sheriff's deputies responded to a reported auto-pedestrian crash on Clay Road near Highway 6 in northwest Harris County. According to the sheriff's office, ICE agents were pursuing a white truck carrying two men when the truck began driving the wrong way down Clay Road and came to a stop. The two men then fled on foot. One of them, Miguel Parra-Hernandez, was struck by an ICE vehicle driven by Morales, who was behind the wheel of a 2025 Jeep Grand Cherokee, an unmarked black SUV, according to prosecutors.

Teare told reporters on October 30 that video footage showed Morales aggressively steering his vehicle into Parra-Hernandez. "As you can clearly see Morales aggressively steered his vehicle into Parra-Hernandez. Not only did he hit Mr. Hernandez, he ran over both of his legs, leaving him seriously injured and hospitalized to this day," Teare said. Body-camera footage shared by the district attorney's office showed Morales getting out of his vehicle after the collision, with Parra-Hernandez on the ground crying out in pain.

Parra-Hernandez was rushed to a local hospital, where he underwent surgery for a broken leg. His family and representatives say he also suffered injuries to his hip and ankle. His lawyer, Kim Bruno, has said Parra-Hernandez has lived in the United States for more than three decades — arriving at age 14 — and has no criminal record. The Department of Homeland Security has said he was in the country without legal permission.

Background and Context

The October 10 operation was, according to ICE, a targeted enforcement action aimed at arresting Jose Mendoza-Cervantes, a man the agency said had a deportation order and four prior arrests. ICE released a photograph of Mendoza-Cervantes and said he had been seen entering a vehicle with Parra-Hernandez. The agency said its officers were not targeting Parra-Hernandez or the other man in the truck.

That account has been sharply disputed. Teare's office has said its investigation found no evidence that Parra-Hernandez and the man ICE identified as Mendoza-Cervantes were in a vehicle together. Bruno has said her client does not know Mendoza-Cervantes and has never heard of him. Reporting by The New York Times added a further twist: the daughter of a man named Jose Hector Jimenez Mendoza shared a death certificate showing he died in 2017, and ICE has not responded to claims that the suspect agents were seeking had been dead for nearly a decade.

The case is the second high-profile Houston investigation Teare has opened into federal immigration enforcement this year. The district attorney, a Democrat, is also investigating the fatal shooting in July 2026 of Lorenzo Salgado Araujo, a 52-year-old Mexican homebuilder, by an ICE officer in Houston — a shooting that set off protests in the nation's fourth-largest city. DHS has said Salgado Araujo had "weaponized his vehicle" and that the officer fired in self-defence.

Investigators also raised concerns about how the vehicle in the Parra-Hernandez case was handled. According to a search-warrant affidavit cited by KPRC 2, ICE officers left the scene with the SUV before investigators completed their work. Teare said officers did not agree to have the vehicle towed for forensic examination and departed while investigators were seeking judicial authorisation to search it. A judge approved a search warrant on October 15, but the warrant return indicated that investigators forwarded it to DHS's legal division and that DHS and ICE had not provided access to the vehicle as of October 23 — a response the return described as "unresponsive." Teare has accused ICE of destroying evidence "either intentionally or through gross negligence," saying removing the vehicle likely erased recorded crash data.

ICE Officer Indicted: The Charge and the Clash Over Jurisdiction

The indictment returned on the morning of October 30 charges Morales with aggravated assault with a deadly weapon, a second-degree felony in Texas carrying a sentence of two to 20 years. The grand jury's decision came after Teare's office reviewed surveillance footage from nearby businesses and recordings provided by bystanders, alongside the body-camera material.

ICE responded swiftly and combatively. In a statement to USA TODAY, an ICE spokesperson called the indictment a "political stunt" and said local government does not have the authority to investigate the case. "Allegations that ICE struck Miguel Parra-Hernandez intentionally are RECKLESS and FALSE. The men and women of ICE are entrusted with upholding the rule of law and are held to the highest standards of professionalism, integrity, and ethical conduct," the spokesperson said. In its original statement after the collision, ICE said Parra-Hernandez had "run in front of an ICE vehicle and was struck" — a version of events Teare says the surveillance footage clearly contradicts.

The jurisdictional dispute is likely to become central to the case. Federal officers generally enjoy certain protections for actions taken within the scope of their duties, and defence lawyers for federal agents frequently seek to move state prosecutions into federal court or argue that the officer was acting under federal authority. Prosecutors, by contrast, argue that deliberately running over a fleeing pedestrian falls outside any lawful enforcement action. No court has yet ruled on those questions, and Morales's lawyers had not publicly responded at the time of the announcement.

Reactions and Quotes

Teare was unsparing at his October 30 news conference at the Harris County criminal courthouse. "The evidence that we have in this case is as clear as any that I've prosecuted or investigated," he said, describing the strike as intentional. He has previously said a charging decision would come "in a relatively short order," and the grand jury's return on Friday fulfilled that promise.

ICE's position has not shifted since the collision: the agency maintains Parra-Hernandez stepped into the path of the vehicle, that the accusations of intent are false and reckless, and that the indictment is politically motivated. A senior DHS official previously told NBC News that an officer had been placed on administrative leave after the collision, but DHS did not immediately respond to requests for comment on the indictment itself.

Advocates in Houston have pointed to the case as evidence that federal enforcement needs independent oversight, while supporters of aggressive enforcement warn that prosecuting officers will chill enforcement. The case lands four days before the November 3 midterms, when immigration enforcement is already a flashpoint.

Why It Matters

The indictment matters for three reasons. First, it tests the practical limits of local accountability for federal officers. If the case proceeds in state court, it could embolden other local prosecutors to bring charges over enforcement tactics; if it is moved or dismissed on federal-authority grounds, it would reinforce how difficult such prosecutions are. Second, it puts the handling of evidence under scrutiny: the dispute over the SUV, the search warrant and the alleged loss of crash data could shape how future collisions involving federal vehicles are investigated. Third, it arrives at a moment of intense public attention on immigration enforcement tactics in American cities, from vehicle pursuits to the use of force against people fleeing on foot — and the video at the heart of this case means the public will be able to judge the competing accounts for itself.

What Happens Next

Morales will face arraignment in Harris County criminal court, where he is expected to enter a plea and where his lawyers may challenge the court's jurisdiction or seek to transfer the case to federal court. Prosecutors will have to prove intent — that Morales deliberately steered into Parra-Hernandez rather than striking him accidentally during a fast-moving pursuit. The video evidence, the body-camera footage and any crash data recovered from the SUV will be central. Teare's investigation into the July fatal shooting of Lorenzo Salgado Araujo continues separately, and any civil claims over Parra-Hernandez's injuries will unfold alongside the criminal case.
